32330  —  Subdivision & Titling Process

Approvals & Statutory Process (32300)
1

Overview

Subdivision and titling is the process by which a parcel of land is divided into two or more separately title-able lots, or by which a building is divided into separately title-able units, following the grant of development consent. Node 32330 addresses the procedural stages of subdivision, the certification required before new titles may issue, and the relationship between subdivision approval and the Torrens title registration system.

Subdivision typically proceeds in two stages: a subdivision development consent, which may be granted concurrently with or following the substantive development consent, and a subdivision certificate confirming that conditions of consent and required engineering works have been satisfactorily completed. Registration of the resulting plan of subdivision with the relevant land titles office then creates the new, separately dealable titles.

Strata and community title subdivision, used for multi-unit residential and mixed-use developments, follows an analogous but procedurally distinct pathway from standard freehold subdivision, reflecting the additional requirement to register a strata or community plan establishing common property and an owners corporation.

Scope & Boundaries

This node covers:

  • The procedural stages of subdivision from development consent through to plan registration
  • The relationship between subdivision certification and Torrens, strata and community title registration

This node does not cover:

  • The development application process granting the substantive development consent that precedes subdivision → refer to Node 32310
  • The legal characteristics of Torrens title and strata title once registered → refer to Nodes 35120 and 35130
  • Conveyancing and settlement procedures applicable to the sale of a subdivided lot → refer to Node 35250
Scope Note — Subdivision Consent vs. Subdivision Certificate

Subdivision development consent authorises the subdivision in principle, while a subdivision certificate, issued following completion of required works, is the instrument that permits registration of the plan of subdivision. The two should not be conflated, as the certificate may issue substantially after the underlying consent.

Key Concepts

Plan of Subdivision
The surveyed plan depicting the boundaries of the new lots created by a subdivision, lodged for registration with the relevant land titles office following satisfaction of subdivision conditions.
Subdivision Certificate
A certificate confirming that conditions of development consent relevant to subdivision, and any required engineering works, have been satisfactorily completed, and that the plan of subdivision may proceed to registration.
Staged Subdivision
An approach under which a subdivision consent permits registration of successive plans of subdivision for discrete stages of a larger development as each stage is completed, rather than requiring completion of the whole site before any titles issue.
Strata Plan / Community Plan
A plan registered to subdivide a building or community development into separately title-able lots together with common property, establishing an owners corporation responsible for the management of that common property.
