### 35630  —  Compulsory Acquisition & Compensation

Dispute Resolution & Litigation (35600)

1
#### Overview

Node 35630 addresses the compulsory acquisition of privately owned property by government and statutory authorities for a public purpose, and the just terms compensation regime that applies to landowners whose property is acquired. Compulsory acquisition is a distinct legal process from ordinary court litigation, arising not from a dispute between private parties but from the exercise of a statutory power vested in government, and it is accompanied by a corresponding statutory obligation to compensate the affected landowner on just terms.

Acquiring authorities exercise compulsory acquisition powers for purposes including road and rail infrastructure, utilities corridors, schools, and other public works, following a defined statutory process of notice, negotiation, and, where agreement is not reached, compulsory acquisition by gazettal. Compensation is assessed by reference to defined statutory heads, principally the market value of the land acquired, together with disturbance costs and, where only part of a holding is acquired, compensation for injurious affection or severance to the land retained.

This node serves landowners affected by a proposed or completed acquisition, and the advisers assisting them, in understanding the acquisition process and the basis on which compensation is assessed, complementing the general dispute resolution framework addressed in node 35600 and the formal court litigation process addressed in node 35620.

2
#### Scope & Boundaries

This node addresses the compulsory acquisition process and the statutory heads of compensation payable to an affected landowner. It does not address the detailed valuation methodology applied in assessing compensation, addressed in nodes 36510, 36520, and 36530, nor the general court litigation process that applies where a compensation dispute is referred to a court, addressed in node 35620.

It does not address the acquisition or resumption of Crown land or native title interests, addressed in node 35140.

Scope Note
This node describes generally applicable principles of Australian compulsory acquisition and just terms compensation as at the time of writing. The acquiring authorities, statutory process, and heads of compensation available vary between Commonwealth, state, and territory legislation and should be confirmed against the applicable acquiring authority's enabling legislation before a matter is progressed.

3
#### Key Concepts

Compulsory Acquisition
The statutory power by which a government or authorised authority may acquire privately owned land for a public purpose without the consent of the owner, subject to a defined notice process and a corresponding obligation to pay compensation.

Just Terms Compensation
The principle, given effect in state, territory, and Commonwealth acquisition legislation, that a landowner whose property is compulsorily acquired is entitled to compensation that leaves the owner in no worse a financial position than if the land had not been acquired.

Market Value (Compensation Head)
The principal head of compensation, assessed as the amount the acquired land might have been expected to realise if sold by a willing but not anxious seller to a willing but not anxious buyer as at the date of acquisition.

Disturbance Costs
A head of compensation covering the reasonable costs incurred by the landowner as a direct and natural consequence of the acquisition, including relocation costs, legal and valuation fees, and, in some cases, costs associated with relocating a business conducted on the land.

Injurious Affection & Severance
A head of compensation available where only part of a landholding is acquired, covering the diminution in value of the land retained by the owner as a consequence of the acquisition or the use to which the acquired land is put.

#### Regulatory & Legal Framework

-

Land Acquisition (Just Terms Compensation) Act 1991 (NSW)
and equivalent state and territory legislation — administered by the relevant acquiring authority together with the state Valuer-General or equivalent statutory valuation authority — establishes the compulsory acquisition process and the statutory heads of compensation payable to an affected landowner.

-

Lands Acquisition Act 1989 (Cth)
administered by the Commonwealth — governs the compulsory acquisition of land by Commonwealth authorities for Commonwealth purposes.

-

Valuation of Land Act (state-based, for example the Valuation of Land Act 1916 (NSW) and equivalent legislation in other states)
administered by the state Valuer-General — establishes the statutory basis on which market value is assessed for acquisition and other statutory purposes.

5
#### Practical Application

The compensation payable to an affected landowner reflects the specific heads applicable to the acquisition, and the extent of the holding acquired.

| Scenario | Application | Outcome |
| -------- | ----------- | ------- |
| A road widening project requires a strip of frontage land from an existing property | The acquiring authority issues a proposed acquisition notice and negotiates with the landowner before proceeding to compulsory acquisition if agreement is not reached | The landowner receives compensation for the market value of the land taken and any associated disturbance costs |
| A rail corridor acquisition takes only part of a larger rural holding | The acquiring authority's valuer assesses the diminution in value of the retained land arising from severance and injurious affection | Compensation includes the market value of the land acquired plus an amount for the reduced value of the remaining holding |
| A landowner disputes the acquiring authority's compensation offer | The landowner refers the compensation dispute to the relevant court or tribunal for independent determination | The court or tribunal determines the compensation payable in accordance with the applicable just terms legislation |
