### 35500  —  Mortgages & Security Interests

Components: 3 · Property Law (Technical) (35000)

1
#### Overview

Node 35500 addresses the legal framework governing mortgages and other security interests taken over real property in Australia. It establishes the architecture within which lenders secure their financial exposure against property assets, spanning the registration of mortgages on title, the priority and enforcement of security interests, and the personal guarantees frequently required to support property finance.

The scope of node 35500 spans three subordinate nodes: mortgage structure and registration, addressed in node 35510; default, enforcement, and mortgagee sale, addressed in node 35520; and guarantees and personal security, addressed in node 35530. Each of these subordinate nodes examines a distinct dimension of secured property finance, while this node provides the architectural orientation connecting them.

This node serves lenders, borrowers, brokers, and advisers requiring a structural understanding of how security interests over Australian real property are created, registered, and enforced, complementing the residential and commercial lending detail addressed in the 33200 series.

2
#### Scope & Boundaries

This node and its subordinate series address the creation, registration, priority, and enforcement of mortgages and other security interests over Australian real property, together with the personal guarantees commonly required to support such lending. It does not address the underlying finance structures and lending products themselves, addressed in the 33200 series, nor the due diligence undertaken by a purchaser or lender ahead of a transaction, addressed in the 33500 series.

Coverage extends across all Australian states and territories, each of which maintains its own Torrens title registration system for registered mortgages, operating alongside the Commonwealth personal property securities regime for security interests in property other than land.

Scope Note
This node describes generally applicable principles of Australian mortgage and security law as at the time of writing. It does not constitute legal or financial advice, and practitioners should obtain advice specific to the relevant transaction before acting.

5
#### Practical Application

Mortgage and security interest principles manifest differently according to the stage of the lending relationship concerned, though each application is ultimately grounded in the terms of the registered mortgage or security interest.

| Scenario | Application | Outcome |
| -------- | ----------- | ------- |
| Lender advances finance secured by a residential property | Lender registers a mortgage on the title to the property, establishing its priority against subsequent dealings | Lender's security interest is protected against later-registered interests from the date of registration |
| Borrower defaults on a secured loan | Lender exercises its power of sale under the registered mortgage following the required notice period | Property is sold and proceeds applied to the outstanding debt in accordance with the priority of registered interests |
| Parent provides a guarantee to support a child's home loan | Lender assesses the guarantor's capacity and requires independent legal advice before accepting the guarantee | Loan proceeds on terms supported by the guarantee, with the guarantor's exposure limited to its terms |
