Components: 6 · Property Encyclopedia & Technical Guides (30000)

1
#### Overview

Property law comprises the body of statutory and common law principles that establish, transfer, encumber, and enforce interests in real property in Australia. It underpins every other series within the 30000 Property Encyclopedia, in that the acquisition, development, financing, management, and valuation of property assets addressed elsewhere in the encyclopedia each proceed within a legal framework of title, contract, leasing, and security law established by this series.

The scope of the 35000 series spans property rights and ownership structures, including the Torrens title system that underlies land registration in every Australian state and territory; contracts and agreements governing the sale of real property; leasing law across residential, commercial, and retail tenancies; land use, zoning, and planning law; mortgages and other security interests; and the dispute resolution and litigation frameworks through which property law obligations are enforced. Australian property law is substantially state-based, with each state and territory maintaining its own Torrens title legislation, tenancy legislation, and conveyancing framework, notwithstanding areas of Commonwealth law such as native title and foreign investment approval that apply nationally.

This node serves as the architectural reference for the 35000 series, orienting practitioners toward the appropriate sub-series node for a given legal question. Property and conveyancing lawyers, licensed conveyancers, real estate agents, developers, and institutional and private investors are the principal audience, together with the advisers who support them in property transactions and disputes.

2
#### Scope & Boundaries

This node and its subordinate series address the legal principles and statutory frameworks governing property rights, contracts, leasing, land use, security interests, and dispute resolution in the Australian property market. It does not address the valuation of property interests, which is addressed in the 36000 series, nor property and casualty insurance, which is addressed in the 37000 series, though each of these subjects intersects materially with property law in practice.

Coverage reflects the state-based character of Australian property law, with individual sub-series nodes addressing state and territory variation in Torrens title, tenancy, and conveyancing legislation, while noting the Commonwealth frameworks, such as the Native Title Act 1993 (Cth), that apply on a national basis.

Scope Note
This node and its subordinate series describe generally applicable Australian property law principles and statutory frameworks as at the time of writing. They do not constitute legal advice, and practitioners should obtain advice specific to the relevant state or territory and the particular facts of a transaction or dispute before acting.

#### Key Concepts

Torrens Title System
The system of land title registration operating in every Australian state and territory, under which the state guarantees the accuracy of the register and title passes on registration rather than on execution of a transfer document, addressed in detail in node 35120.

Freehold Estate

Contract of Sale
The legally binding agreement under which an interest in real property is agreed to be transferred from vendor to purchaser, incorporating standard and special conditions and, in most jurisdictions, mandatory vendor disclosure requirements, addressed in detail in node 35210.

Registered Mortgage
A security interest registered on the title to real property in favour of a lender, conferring a right to take possession and sell the property in the event of default on the secured obligation, addressed in detail in node 35510.

Native Title
The recognition under Australian common law and the Native Title Act 1993 (Cth) of the rights and interests of Aboriginal and Torres Strait Islander peoples in land and waters according to their traditional laws and customs, addressed in detail in node 35140.

#### Regulatory & Legal Framework

- Real Property Act 1900 (NSW)State Land RegistriesAnd equivalent state and territory Torrens title legislation establishes the system of title registration under which interests in real property are created, transferred, and encumbered.
- Conveyancing Act 1919 (NSW)State Attorneys-General DepartmentsAnd equivalent state and territory conveyancing legislation governs the transfer of real property interests and the conduct of conveyancing transactions.
- Residential Tenancies Act 2010 (NSW)State Fair Trading & Consumer Affairs RegulatorsAnd equivalent state and territory residential tenancy legislation governs the rights and obligations of landlords and tenants under residential tenancy agreements.
- Native Title Act 1993 (Cth)National Native Title TribunalGoverns the recognition, determination, and management of native title interests in land and their interaction with other property rights.

5
#### Practical Application

Property law principles manifest differently according to the nature of the transaction or interest concerned, though each is ultimately grounded in the Torrens title register maintained by the relevant state or territory.

| Scenario | Application | Outcome |
| -------- | ----------- | ------- |
| Purchaser acquires a freehold residential property under a standard contract of sale | Conveyancer conducts title searches, reviews vendor disclosure, and lodges the transfer for registration under the Torrens system | Purchaser obtains an indefeasible registered title subject only to disclosed and registered encumbrances |
| Landlord and tenant enter a residential tenancy agreement | Parties execute an agreement governed by the applicable state residential tenancy legislation, establishing rent, bond, and condition obligations | Tenancy proceeds under a legislated framework enforceable through the relevant state tribunal |
| Developer proposes a project on land subject to a native title claim | Developer engages with the future act provisions of the Native Title Act 1993 (Cth) before proceeding | Development proceeds only where native title interests have been addressed in accordance with Commonwealth law |
