Residential Property Management (34100)

#### Overview

Rent collection is the process by which a managing agent or landlord receives the periodic rent payable under a residential tenancy agreement, typically through a regulated trust account maintained by a licensed managing agent. Arrears management is the corresponding process applied where a tenant fails to pay rent by the date it falls due, encompassing early intervention, formal notice, and, where arrears remain unresolved, the pathway to termination of the tenancy through the relevant state tribunal.

Arrears management operates within a sequence prescribed, in most respects, by state and territory residential tenancy legislation, which specifies the notice period a landlord must provide before an arrears-based termination application may be made and the grounds on which a tribunal may make a termination order. A managing agent's arrears process is accordingly structured around compliance with these prescribed steps, in addition to the practical objective of resolving arrears before they escalate to termination.

This node addresses rent collection and arrears management specifically, following on from the lease agreement addressed in node 34120, which establishes the rent payable, and connecting to the broader tenant communication and dispute resolution process addressed in node 34150 where arrears give rise to a wider dispute.

#### Scope & Boundaries

**This node covers:**

- Collection of rent under a residential tenancy agreement
- Management of tenant arrears, including notice requirements and the pathway to tribunal for non-payment of rent

**This node does not cover:**

- Recovery of outgoings under a commercial or retail lease → refer to Node 34220
- Tenant communication and dispute resolution more broadly → refer to Node 34150

Scope Note
This node describes generally applicable rent collection and arrears management practice as at the time of writing. It does not constitute legal advice, and the specific notice periods and tribunal process applicable to an arrears matter depend on the residential tenancy legislation of the relevant state or territory.

#### Key Concepts

Rent Ledger
The record maintained by a managing agent, typically within a trust accounting system, of rent payments received against a tenancy, used to identify when a tenant has fallen into arrears and by what amount.

Arrears Notice
A formal notice served on a tenant, in the form and within the timeframe prescribed by the applicable residential tenancy legislation, advising that rent is overdue and specifying the amount owing and the consequence of continued non-payment.

Termination for Non-Payment of Rent
The process by which a landlord may apply to the relevant state tribunal for an order terminating a tenancy on the grounds of rent arrears, available only where the prescribed notice has been given and the arrears remain unresolved for the period specified in the applicable legislation.

Payment Plan
An arrangement agreed between landlord and tenant, or ordered by a tribunal, under which arrears are repaid over time in addition to ongoing rent, used as an alternative to termination where a tenant demonstrates capacity to resolve the arrears.

Tribunal Application
The formal application made to a state civil and administrative tribunal seeking a termination order or other relief in relation to unresolved rent arrears, determined according to the evidence of the rent ledger and the notices given.

#### Regulatory & Legal Framework

-

Residential Tenancies Act 2010 (NSW)
State fair trading regulators
And equivalent state and territory residential tenancy legislation, prescribing the notice periods and grounds applicable to termination of a tenancy for non-payment of rent.

-

Civil and Administrative Tribunal Act 2013 (NSW)
Relevant state tribunals
And equivalent state tribunal legislation, establishing the forum in which a termination application or arrears dispute is determined.

-

Property and Stock Agents Act 2002 (NSW)
State fair trading regulators
And equivalent state agents' licensing legislation, governing the trust account handling of rent monies collected by a managing agent, including reconciliation and audit obligations.

-

State rental bond authority legislation
State fair trading regulators
Such as the Rental Bond Board under the Residential Tenancies Act 2010 (NSW), governing the landlord's ability to claim against a tenant's bond for unresolved arrears at the conclusion of a tenancy.

5
#### Practical Application

Arrears management practice generally follows an escalating sequence, moving from informal contact to formal notice and, only where earlier steps do not resolve the matter, to a tribunal application, reflecting both legislative process and the commercial preference of most landlords to retain a paying tenant over pursuing termination.

| Scenario | Application | Outcome |
| -------- | ----------- | ------- |
| Tenant misses a rent payment by a small number of days for the first time | Managing agent makes informal contact to confirm payment timing before issuing a formal arrears notice | Arrears are resolved without formal escalation, and the tenancy continues uninterrupted |
| Tenant falls into sustained arrears and does not respond to informal contact | Managing agent issues the formal arrears notice prescribed under the applicable tenancy legislation, specifying the amount owing and the consequence of continued non-payment | Tenant is placed on formal notice, establishing the basis for a tribunal application if arrears remain unresolved |
| Arrears remain unresolved beyond the notice period and the tenant does not engage with a proposed payment plan | Managing agent lodges a termination application with the relevant state tribunal on the ground of non-payment of rent | Tribunal determines the application according to the rent ledger and notice evidence, potentially resulting in a termination order |
