Components: 5 · Property Management & Operations (Technical) (34000)

1
#### Overview

Residential property management is the discipline of administering a residential rental property on behalf of its owner across the full tenancy lifecycle, from tenant selection through to lease renewal or vacancy. It is typically performed by a licensed managing agent acting under an agency agreement with the property owner, though a minority of owners self-manage subject to the same underlying tenancy legislation.

The residential property management function sits at the intersection of commercial service delivery and consumer protection regulation. A managing agent owes contractual and fiduciary obligations to the property owner as principal, while simultaneously operating within a residential tenancies framework designed to protect the interests of the tenant as an occupant of the property. Effective residential property management requires the managing agent to balance these obligations across tenant screening, lease documentation, rent collection, maintenance coordination, and the resolution of disputes that arise during a tenancy.

This node serves as the group index for the residential property management sub-series, which addresses each stage of the tenancy lifecycle in turn: tenant screening and selection (node 34110), lease agreements and renewals (node 34120), rent collection and arrears management (node 34130), repairs, maintenance and inspections (node 34140), and tenant communication and dispute resolution (node 34150).

#### Scope & Boundaries

**This node covers:**

- Management of residential rental properties let under a residential tenancy agreement, including single dwellings, townhouses, and residential apartments
- National coverage, noting that specific tenancy legislation, prescribed forms, and bond authority arrangements vary by state and territory

**This node does not cover:**

- Commercial or retail tenancy management → refer to Node 34200
- Common property management within a strata scheme → refer to Node 34300
- Short-term and holiday letting arrangements → refer to Node 34400

Scope Note
This node describes generally applicable residential property management practice as at the time of writing. It does not constitute legal advice, and a managing agent or self-managing landlord should confirm the specific requirements of the residential tenancy legislation applicable in the relevant state or territory before acting.

3
#### Key Concepts

Agency Agreement
The contract between a property owner and a licensed managing agent under which the agent is authorised to let, manage, and collect rent for a residential property, setting out the agent's fee, authority, and reporting obligations to the owner.

Trust Account
A separate, regulated bank account maintained by a licensed managing agent for the receipt of rent, bond, and other client monies, held on behalf of property owners and tenants and subject to audit and reconciliation requirements under state agents' licensing legislation.

Tenancy Lifecycle
The sequence of stages through which a residential tenancy progresses, comprising tenant application and screening, execution of the tenancy agreement, the occupied tenancy period including rent collection and maintenance, and conclusion of the tenancy by expiry, renewal, or termination.

Condition Report
A documented record of the condition of a residential property prepared at the commencement and conclusion of a tenancy, used to assess any claim against the tenant's bond for damage beyond fair wear and tear.

Rental Bond
A sum of money paid by a tenant at the commencement of a tenancy as security against damage or unpaid rent, typically lodged with a state or territory rental bond authority rather than retained by the managing agent or landlord.

#### Regulatory & Legal Framework

-

Residential Tenancies Act 2010 (NSW)
State fair trading / consumer affairs regulators
And equivalent state and territory residential tenancy legislation, governing the rights and obligations of landlords, tenants, and managing agents throughout the tenancy lifecycle.

-

Property and Stock Agents Act 2002 (NSW)
State fair trading regulators
And equivalent state agents' licensing legislation, governing the licensing, trust account, and conduct obligations of residential managing agents.

-

Australian Consumer Law
Australian Competition and Consumer Commission; state consumer affairs regulators
As applied under the Competition and Consumer Act 2010 (Cth), applies to unfair contract terms in standard form tenancy agreements and misleading conduct in the advertising of rental properties.

-

State rental bond authority legislation
State fair trading regulators
Such as the Rental Bond Board under the Residential Tenancies Act 2010 (NSW), governing the lodgement, holding, and release of rental bonds.

5
#### Practical Application

Residential property management practice is shaped by the volume of properties under management and the owner's preference for involvement, ranging from a self-managing individual landlord to an institutional owner managing a large residential portfolio through a dedicated management platform.

| Scenario | Application | Outcome |
| -------- | ----------- | ------- |
| Individual owner of a single investment property engages a local managing agent | Agent screens tenants, prepares the tenancy agreement, lodges the bond, and manages rent collection and routine maintenance requests | Owner receives ongoing management with minimal direct involvement, subject to the agent's periodic reporting |
| Build-to-Rent operator manages several hundred residential dwellings within a single asset | Operator establishes an in-house residential property management function with standardised systems for screening, leasing, and maintenance across the portfolio | Consistent tenant experience and operational efficiency are achieved at portfolio scale, distinct from single-property agency management |
| Tenancy dispute arises over an alleged breach of the tenancy agreement | Managing agent applies the communication and dispute resolution process addressed in node 34150 before escalation to the relevant state tribunal | Dispute is resolved, or escalated to tribunal, in accordance with the applicable residential tenancy legislation |
