Land & Vacant Sites (31600)

1
#### Overview

Rural land (non-agricultural) comprises land held within a rural zone but used, or held, for a purpose other than agricultural production. The classification encompasses land held in anticipation of future urban release, land reserved or acquired for infrastructure corridors, land used for non-agricultural rural pursuits such as lifestyle use, and rural land held for land banking purposes pending a change in zoning or planning status. Its defining characteristic is the absence of a current agricultural use generating farm income, notwithstanding the land's rural zoning.

Rural land (non-agricultural) is distinguished from greenfield land, addressed at Node 31610, by the absence of a designated growth corridor or future urban zone identification at the time of classification; rural land held outside an identified growth corridor, but nonetheless held with a view to eventual urban conversion over a longer timeframe, falls within this node. It is similarly distinguished from rural and agricultural property addressed in Sub-Series 31300, which covers land in current agricultural production.

Land banking activity and rezoning outcomes in non-agricultural rural land are tracked separately through APN's market analysis series, which sits outside the scope of this technical reference.

2
#### Scope & Boundaries

**This node covers:**

- Classification of rural-zoned land held for a non-agricultural purpose
- Land banking strategy applicable to rural land pending rezoning or infrastructure delivery
- Infrastructure corridor reservation affecting rural land holdings
- Subdivision controls applicable to rural-zoned land, including minimum lot size requirements

**This node does not cover:**

- Land in current agricultural production → refer to Sub-Series 31300
- Greenfield land within an identified growth corridor → refer to Node 31610
- Lifestyle and hobby farm property as a residential property category → refer to Node 31330
- Foreign investment approval processes applicable to a specific acquisition → refer to Node 33610

Scope Note
Land within a rural zone that supports a dwelling and incidental non-agricultural use, but does not generate agricultural income, is classified under this node rather than as rural and agricultural property; classification turns on current use and income generation, not zoning alone.

#### Key Concepts

Rural Land (Non-Agricultural)
Land held within a rural zone but used, or held, for a purpose other than agricultural production, including land banking, future urban release, infrastructure reservation and non-agricultural rural pursuits. Classification depends on current use rather than zoning designation alone.

Land Banking in Rural Zones
The acquisition and holding of rural land in anticipation of a future change in zoning or planning status, typically pending eventual identification within a growth corridor or future urban zone. Land banking in rural zones is typically held over a longer timeframe and with greater rezoning uncertainty than land banking within an identified growth corridor.

Infrastructure Corridor Reservation
The identification and, in some cases, acquisition of rural land required for a future transport, utility or other infrastructure corridor. Reserved land is typically subject to planning controls restricting development pending the infrastructure authority's confirmation of the final corridor alignment.

Rural Subdivision Controls
Minimum lot size and other subdivision controls applicable to rural-zoned land, set by the relevant state or local planning instrument to maintain the land's capacity to support agricultural use or to manage the rate of rural-residential conversion.

#### Regulatory & Legal Framework

- State rural and regional planning legislationState Planning DepartmentsGoverns minimum lot size, subdivision and permissible use controls applicable to rural-zoned land.
- State infrastructure and major projects legislationState infrastructure authoritiesGoverns the identification, reservation and compulsory acquisition process applicable to land required for an infrastructure corridor.
- Foreign Acquisitions and Takeovers Act 1975 (Cth) and FIRB PolicyForeign Investment Review BoardApplies materially lower notification thresholds to the acquisition of rural land by foreign persons relative to other property categories.
- Native Title Act 1993 (Cth) and state Crown land legislationNational Native Title Tribunal and state Crown land authoritiesApplies to rural land where native title interests have not been extinguished or where the land is held under Crown leasehold tenure.

5
#### Practical Application

| Scenario | Application | Outcome |
| -------- | ----------- | ------- |
| Investor assessing rural land held outside a current growth corridor for long-term land banking | Holding cost, rezoning uncertainty and infrastructure delivery timeline assessed against the acquisition price | Hold/acquire recommendation supported by a long-horizon land banking assessment |
| Infrastructure authority identifying a future transport corridor across rural-zoned holdings | Corridor alignment options assessed against existing rural land use and subdivision pattern | Preferred corridor alignment identified with affected landholdings noted |
| Foreign purchaser assessing approval requirements for a rural land acquisition | Notification thresholds and conditions applicable under FIRB policy applied to the proposed acquisition | Approval pathway and timeline confirmed prior to acquisition |
